You are eligible to petition for a PFA order from an abuser who is:
- A spouse or former spouse
- Someone you lived with as a couple
- Someone with whom you have a child
- Someone you are dating or dated in the past
- A relative
The first step is to petition for an emergency order. This is to help protect you and any children you have from immediate danger. It can be based on actual acts of mental, emotional or physical abuse, or perceived threats. These orders are often granted right away. The other person is notified and ordered not to have any contact with you.
A hearing will be scheduled, usually within a week, to determine if a permanent PFA order should be issued. During this hearing, you will have the opportunity to present evidence of abuse or threats that you experienced. A judge will rule on whether not a permanent PFA is warranted. If issued, the PFA may be in effect for up to two years.
It’s important to know that during the hearing, the person who has been threatening or abusing you has the right to respond and challenge the order. But one of our attorneys will be by your side and will fight for your rights.
